This Warranty is the strongest in the industry, and it’s Forever.
We guarantee that DreamCloud will be free from defects in workmanship and materials for as long as you own and use DreamCloud.

Warranty Highlights

1. For the first 10 years of ownership, we will replace your mattress with a brand new DreamCloud at absolutely no charge to you if defective in workmanship and materials. In years 10+ DreamCloud will completely repair and re-cover your DreamCloud, or replace your DreamCloud. All transportation charges will be waived if a manufacturing defect(s) or a materials failure is confirmed to exist.

2. Your mattress must be used on an appropriate base such as a platform bed or other suitable bed frame.

3. The warranty applies only as long as the original owner of the DreamCloud mattress owns the DreamCloud.

4. The warranty does not apply if mattress has been burned or otherwise abused, damaged, misused, or neglected.

5. In order to provide the most optimum sleeping surface the DreamCloud mattress contains only the finest quality materials. As with all premium sleep products, certain adaptations will take place as your mattress adjusts to your body shape. This is to be expected and is part of the performance of your mattress. Normal body impressions (not greater than 4cm) are not defects and are not covered by the warranty. Excessive body impressions of greater than 4cm are covered by the Forever Warranty for as long as the original purchaser of the DreamCloud mattress owns it.

DREAMCLOUD MATTRESS WARRANTY COVERAGE

LIMITED WARRANTY TERMS

Your new DreamCloud mattress (“Mattress”) and DreamCloud Mattress Cover (“Mattress Cover”) is covered by a Limited DreamCloud Forever Warranty (the “Warranty”), while it is located in the UK Mainland, for the full period of the original owner’s (“you”) ownership and use.

WHO IS COVERED

This warranty is valid only for the original purchaser from the original purchase date of the Mattress and is non-transferable. The “original purchaser,” for the purposes of this Warranty, is the first purchaser of the Mattress from DreamCloud. Please retain a copy of your receipt as proof of purchase and owner.

If the original purchaser sells or otherwise relinquishes ownership of the Mattress or Mattress Cover to another person, this Warranty terminates and the subsequent owner accepts that the Mattress or Mattress Cover shall not have the benefit of this Warranty.

WHAT IS WARRANTED

This Warranty extends to Mattresses manufactured by DreamCloud (“DreamCloud”) and purchased directly from
DreamCloud. Some parts of this Warranty also extend to Mattress Covers.

DreamCloud warrants the Mattress and Mattress Cover, in its original packaging, sold to you shall be free from defects in material and workmanship set forth below (“Defects”) for the full period of ownership by you and use by you commencing from the time your Mattress or Mattress Cover is delivered to you.

Replaced or repaired Mattresses or Mattress Covers are subject to the same Warranty as the original Mattress (or ”Mattress
Cover”). For example, if you obtain a replaced or repaired Mattress or Mattress Cover the warranty term of the replaced or repaired Mattress or Mattress Cover begins from the date of purchase of the original Mattress or Mattress Cover.

Replaced or repaired Mattresses are subject to the same Warranty as the original Mattress. For example, if you obtain a replaced or repaired Mattress the warranty term of the replaced or repaired Mattress begins from the date of purchase of the original Mattress.

THE FOLLOWING DEFECTS ARE COVERED

  • Deterioration causing the Mattress to have a visible indentation greater than 4cm (one and one half inches) that is not associated with an indentation or sag which results from use of an improper or unsupportive foundation or bed base.
  • If using a slatted bed base, in order for your DreamCloud mattress to be adequately supported, the minimum width of each slat must be 5cm with a slat distance of no more than 9cm.
  • Any physical flaw in the Mattress that causes the foam material to evidence degradation, split or crack, despite normal usage and proper handling.
  • Any manufacturing defect in the assembly of the Mattress Cover.

THIS MATTRESS AND MATTRESS COVER WARRANTY DOES NOT COVER

  • Any Mattress or Mattress Cover which has been subject to misuse, neglect, accident
    or used in violation of instructions, including instructions to place the
    Mattress on proper bed frame.
  • A normal increase in softness of the foam pressure-relieving material which does
    not affect the pressure-relieving qualities of the Mattress
  • Comfort preference.
  • Defects caused by physical abuse or damage to the structure and/or cover material, including but not limited to, burns, cuts, tears, liquid damage, or stains.
  • Mattresses or Mattress Covers sold “reconditioned”, “used”, “returned”, “previously owned”, or any other similar wording indicating that the Mattress or Mattress Cover is not “new” or of “first quality”, or has previously been purchased or used by another consumer

ASSESSMENT OF A WARRANTY CLAIM BY A THIRD PARTY

  • In order to provide an independent assessment of your mattress, we have opted to use the Emmiera Assessment Service (Emmiera is used by the UK Furniture & Home Improvement Ombudsman for their own assessments and investigations). We use Emmiera as these technicians are fully trained and qualified to test for any manufacturing faults that are covered under your Forever Warranty.
  • We have the right to send a Emmiera specialist if we are unable to identify the initial issue reported by you.
  • The Emmiera Inspector will only carry out their duties if the mattress is on a type of bed frame or support frame/base, they cannot assess mattresses that are on the floor.
  • They will carry out an observation of your set up and ask you some general questions around how you use and maintain the mattress. They will also inspect the frame that is being used to support your mattress.
  • They will complete a careful inspection of your mattress and produce a full report.
  • Please be aware that DreamCloud makes a final decision based on the independent 3rd party recommendation on whether a mattress is defective and qualifies for repair or replacement.
  • DreamCloud therefore reserves the right to not offer a replacement or repair if the assessment concludes that the product is not defective.
  • We accept no liability for any consequential losses incurred in relation to you waiting to confirm the Emmiera appointment or on the day of the Emmiera appointment.

WARRANTY REMEDY

In the event of a Defect (as defined above), DreamCloud’s sole liability and your sole remedies under this Warranty will be:

For the first 10 years of ownership, we will replace your mattress with a brand new DreamCloud at absolutely no charge to you.
In years 10+ DreamCloud will completely repair and re-cover your Mattress/Mattress Cover, or replace your Mattress/Mattress Cover, at our option. The only charge you will incur will be a transportation costs of £65 each way, which charges will be waived if a Defect is confirmed by us, to exist.

CLAIMS & ARBITRATION

YOUR RESPONSIBILITIES

In order for this Warranty to apply, the Mattresses must be used on a firm, solid-surface, such as a bed base that is structurally capable of supporting the weight of the Mattress and user(s) for the entirety of its use.

You must return your Mattress or Mattress Cover and show proof of original purchase. In years 10+, You will be responsible for a £65 shipping fee, each way, associated with shipping replaced or repaired Mattress/Mattress Cover. This fee will be waived upon DreamCloud’s confirmation of a Defect in materials or workmanship. At DreamCloud’s option, DreamCloud may authorise you to provide photo evidence of defect in lieu of retuning the Mattress.

MATTRESS WARRANTY LIMITATIONS, DISCLAIMERS, AND LIMITATION OF LIABILITY

This warranty gives you specific legal rights, and you may also have other rights under specific legislation.

To the extent permitted by law, this warranty and the remedies set forth herein are exclusive and in lieu of all other warranties, remedies and conditions, whether oral, written, statutory, express or implied, including without limitation, warranties of fitness for a particular purpose. In so far as such warranties cannot be disclaimed, DreamCloud limits the duration of such warranties to the maximum duration for implied or statutory warranties provided by statute.

DreamCloud limits the remedies for such warranties to, at DreamCloud’s option, the repair or replacement of the Mattress/Mattress Cover described here into the maximum extent permitted by applicable law and except as set forth in this limited warranty, in no event will DreamCloud or its suppliers be liable for procurement of substitute products or other special, incidental, consequential or indirect damages arising out of or related to the Mattress or Mattress Cover or its use by you or any third party, whether under theory of contract, tort (including negligence), indemnity, product liability or otherwise. This limitation will apply even if DreamCloud has been advised of such damages and notwithstanding the failure of essential purpose of any limited remedy. DreamCloud’s total liability will not exceed the purchase price paid for the Mattress or Mattress Cover giving rise to such liability.

GOVERNING LAW

This Limited Warranty will be governed by the laws of England.
